I moved to a mediation practice rather than be a litigator because of the obvious benefits there were to the clients. There is no winner in litigation. What a mediator does is facilitate settlement discussions among people that would prefer not to be in the courthouse. So my role as a mediator is to keep folks away from the courthouse instead of putting them in the courthouse. The way that happens is very simply getting parties together at the same table with or without attorneys, and negotiating a settlement. Part of my mediation practice is in family law, where the parties sit with me at the table and we go through all the pieces of a settlement, whether it's family or whether it's finances, retirement plans, closely held businesses. Put all those pieces together and craft a settlement that is done by you as opposed to a stranger at a courthouse. The better part of my practice is business-related. Parties come to me for such things as a wrongful death case, the dissolution of a partnership or an LLC or a corporation, dispute over banking regulations, construction defects.
